Mr. D.N. Sharma, learned counsel for the applicant submitted that applicant was charge sheeted vide memorandum of charge no.F7-2/16-17/Misc/Discy/D.K. Saharia dated 20.05.2016 and accordingly, the disciplinary authority vide order no.F7-2/16-17/Misc/discy/D.K. Saharia dated 23.01.2017 imposed punishment of recovery of Rs.1,20,000/- in eual installments @ Rs.10,000/-. Learned counsel submitted that applicant has filed appeal 15.02.2017 but the same has not yet been considered even after lapse of more than six months. According to the learned counsel, without deciding the appeal on merits, the respondents have given effect to the order of the disciplinary authority dated 23.01.2017 and started recovery of Rs.10,000/- per month from his salary. Learned counsel for the applicant submitted that, in the interest of speedy justice, he will be satisfied if the appellate authority is directed to dispose of the appeal at the earliest on merits after giving him an opportunity of being heard.

Accordingly, appellate authority is directed to dispose of the appeal dated 15.02.2017 on merits after taking into account all the submissions made therein and giving him an opportunity of being heard by a speaking order at the earliest but not later than three months from the date of receipt of the order.
